Ellabook User Registration and Use of APP Privacy Agreement

Please read this User Agreement (hereinafter referred to as "Agreement") carefully before you register as a user and make sure that you fully understand the terms of this Agreement.

Please read carefully and choose to accept or not accept this Agreement.

Your registration, login, use & etc. will be deemed to be an acceptance of this Agreement and agree to be bound by the terms of this Agreement.

This Agreement stipulates the rights and obligations of Zhengzhou Diandu Electronic Technology Co., Ltd (hereinafter referred to as "Diandu Technology") and the user regarding the software service of Ellabook (hereinafter referred to as "Service"). Users refer to individuals who register, log in and use this service.

This Agreement can be updated by Diandu Technology at any time. The updated terms of the Agreement once announced will replace the original terms of the Agreement without further notice. Users can check the latest version of the terms of the Agreement in this APP. After the terms of the agreement are revised, if the user does not accept the revised terms, please immediately stop using the Service provided by Ellabook, and the user's continued use of the Service will be deemed to accept the revised Agreement.

1. Account registration

1.1 Users need to register for an Ellabook account before using this Service. The Ellabook account should be registered and connected to a mobile phone number. Users are requested to use the mobile phone number that has not been connected to an Ellabook account, and the mobile phone number that has not been blocked by the Service according to this Agreement. The Service can change the registration method according to user needs or product needs without prior notice to users.

1.2 Ellabook is an APP product developed by Diandu Technology. When users register, users should authorize Diandu Technology to use their personal information before they can successfully register for the Ellabook account. Therefore, the user's completion of registration indicates that the user agrees that the Service can extract, disclose and use the user's information.

1.3 In view of the registration method of the Ellabook account, you agree that the Service will allow your mobile phone number and mobile device identification code to be used for registration.

1.4 When a user registers and uses the Service, Ellabook needs to collect personal information that identifies the user so that the Service can contact the user if necessary, or provide a better experience for the user. The information collected by Ellabook includes, but is not limited to the user's name and address; Diandu Technology agrees that the use of this information will be subject to the restrictions of protection of users’ personal privacy information in Article 2.

2. Protection of users' personal privacy information

2.1 If Diandu Technology discovers or receives reports from others or complaints that the user has violated this Agreement, Ellabook reserves the right to review and delete the relevant contents, including but not limited to user information and posting records at any time without notice, and to impose penalties, including but not limited to warnings, account bans, device bans, and function bans, depending on the seriousness of the case, and to notify the user of the processing results.

2.2 Users who have been banned for violating the Agreement can contact Ellabook by themselves. Among them, the user who has been banned by function will automatically restore their banned function after the ban period expires. The banned user can submit an appeal, and Diandu Technology will review the appeal and make a reasonable judgment at its sole discretion whether to change the punishment.

2.3 Users understand and agree that Diandu Technology reserves the right to punish violations of relevant laws and regulations or the provisions of this Agreement according to reasonable judgments, and to take appropriate legal action against any user who violates the law and regulations, and to keep relevant information according to laws and regulations to report to the relevant departments, etc. Users should bear all legal responsibilities arising therefrom.

2.4 Users understand and agree that any claims, demands or losses claimed by any third party, including reasonable attorney fees, caused by the user’s violation of this Agreement, the user shall compensate Diandu Technology and its partner companies, affiliated companies and protect it from damage. We will not deliberately access and collect personal information from children under the age of 13. If you find we have collected such information due to our negligence, please contact us so that we can immediately obtain parental consent or delete this information.

2.5 We will only retain your personal information for the time required to achieve the above-mentioned purposes, and delete or anonymize your personal information after the retention time, unless otherwise required by laws and regulations.

2.6 The specific retention time of your personal data is as follows: In order to continuously optimize the accuracy of voice recognition and improve the user experience, we will collect pseudonymized device identifiers, location information, mobile network codes and mobile device country codes, voice content and result of the recognition of corresponding languages. The data storage period shall be at least 6 months. We will also upload part of your personal data to the server and provide it to a third-party service provider to complete the voice recognition service. The default storage period of the voice content at third party is 3 months.

2.7 If our products or services cease to operate, we will notify you in the form of push notifications, announcements, etc., and delete your personal information or anonymize them within a reasonable period of time.

3. User publishing content specifications

3.1 The content mentioned in this article refers to any content produced, uploaded, copied, published or disseminated during the user's use of using the Service, including but not limited to account avatar, name, user description and other registration information and authentication information, or text, voice, picture, video, graphic that sent, replied or automatically replied and related linked pages, as well as other content generated by using the account or this Service.

3.2 Users are not allowed to use the Ellabook account or this Service to produce, upload, copy, publish or disseminate following contents prohibited by laws, regulations and policies:

3.2.1 Against the basic principles established by the Constitution

3.2.2 Endangering national security, leaking State secrets, subverting State power and undermining national unity

3.2.3 Damaging to national honor and interests

3.2.4 Inciting ethnic hatred and discrimination, and undermining ethnic unity

3.2.5 Undermining national religious policy and promoting cults and feudal superstition

3.2.6 Spreading rumours, disrupting social order and undermining social stability

3.2.7 Spreading obscenity, pornography, gambling, violence, murder, terror or abetting crimes

3.2.8 Insulting or slandering others, infringing upon the legal rights and interests of others

3.2.9 Information containing other contents prohibited by laws and administrative regulations.

3.3 Users are not allowed to use the Ellabook account or this Service to produce, upload, copy, publish or disseminate the following contents that interfere with the normal operation of the Service, and contents that infringe upon the legitimate rights and interests of other users or third parties:

3.3.1 Containing any sexual or sexual implication

3.3.2 Containing abusive, intimidating, or threatening content

3.3.3 Containing harassment, spam, malicious information or deceptive information

3.3.4 Involving the privacy, personal information or data of others

3.3.5 Infringing upon the legal rights of others, such as reputation rights, portrait rights, intellectual property rights, trade secrets & etc.

3.3.6 Containing other information that interferes with the normal operation of this Service and infringes upon the legitimate rights and interests of other users or third parties.

4. Rules of use

4.1 Any content transmitted or published by users in or through this Service does not reflect or represent, nor shall it be deemed to reflect or represent the views, positions or policies of Diandu Technology, and Diandu Technology shall not be liable for this.

4.2 Users are not allowed to use the Ellabook account or this Service to conduct the following acts:

4.2.1 Submitting or publishing false information, or stealing others’ account avatar or profile, or impersonating or using the names of others

4.2.2 Forcing, inducing other users to pay attention or click on a linked page or share information

4.2.3 Making up facts or concealing the truth to mislead or deceive others

4.2.4 Establishing false accounts in batches by technical means

4.2.5 Engaging in any illegal or criminal activity by using the Ellabook account or this Service

4.2.6 Producing and publishing methods and tools related to the above acts, or operating or disseminating such methods and tools, whether or not these acts are for commercial purposes

4.2.7 Other acts that violate laws and regulations, infringe upon the legitimate rights and interests of other users, interfere with the normal operation of Ellabook or acts that are not expressly authorized by the Service.

4.3 The user shall be solely responsible for the authenticity, legality, harmlessness, accuracy and validity of the information transmitted through the account or the Service. Any legal liability related to the information transmitted by the user shall be borne by the user himself, and has nothing to do with Diandu Technology. If damage is caused to Diandu Technology or a third party, the user shall compensate according to law.

4.4 The services provided by Diandu Technology may include advertisements, and users agree to display advertisements provided by Diandu Technology and third-party suppliers and partners during use. Except as expressly provided by laws and regulations, users shall be responsible for the transactions carried out in accordance with the advertising information, and Diandu Technology shall not be liable for any loss or damage suffered by users as a result of the transaction carried out in accordance with the advertising information or the content provided by such advertisers.

5. Information security

5.1 The Ellabook account has security protection function. Please keep your username and password information properly. Ellabook will ensure that your information is not lost, abused and altered by encryption and other security measures. Despite the aforementioned security measures, please also note that there is no "perfect security measure" on the information network.

5.2 When conducting online transactions using the Ellabook network service, you will inevitably disclose your personal information, such as contact information or postal address, to the counterparty or potential counterparty. Please protect your personal information properly and only provide it to others when necessary. If you find that your personal information has been leaked, especially the username and password, please contact the customer service immediately so that you can take appropriate measures.

6. Miscellaneous

6.1 Diandu Technology solemnly reminds users to pay attention to the terms in this Agreement that exempt Diandu Technology's liability and limit the rights of users. Please read carefully and consider the risks independently. Minors should read this Agreement accompanied by legal guardians.

6.2 The validity, interpretation and dispute settlement of this Agreement are applicable to the laws of the People's Republic of China. If there is any dispute or controversy between the user and Diandu Technology, it should be settled through friendly negotiation first. If the negotiation fails, the user should agree to submit the dispute or controversy to the people's court with jurisdiction in the place where Diandu Technology is located.

6.3 Any term of this Agreement is invalid or unenforceable for any reason, the remaining terms still remain valid and binding on both parties.
